CMS grants 90-day grace period for compliance with new eligibility, claim status rules

CMS announced this week that it will not initiate enforcement action until March 31 for HIPAA-covered entities that may not be meeting certain new operating regulations under the Affordable Care Act.

“Industry feedback suggests that [a majority of] HIPAA-covered entities would not be in compliance” with the rules governing eligibility for a health plan and health care claim status, according to a news release.

But CMS’ Office of E-Health Standards and Services compliance date for using the rules remains Jan. 1, 2013, according to the release.

“All applicable covered entities are encouraged to determine their readiness to use the operating rules … and expeditiously become compliant,” according to the announcement.
