LAHAINA, Hawaii — David M. Glaser, JD, discussed ways in orthopedic surgeons can divide their ancillary incomes. He said orthopedic surgeons do not need to divide their ancillary incomes evenly and can divide these based on relative value unit productivity, seniority, with subcomponents or in preordained ways. The Stark Law prohibits a physician group from dividing ancillary income based on who ordered services, and some states have laws that place additional restrictions on how ancillary incomes can be divided, he said.
