ANAHEIM, Calif. — In this video exclusive, I. Glenn Cohen, JD, discusses the impact on reproductive technologies of the recent U.S. Supreme Court decision in Dobbs overturning the federal Constitutional right to abortion.
Cohen, who is the James A. Attwood and Leslie Williams Professor of Law and deputy dean at Harvard Law School, said the logic of the decision could possibly be used by states to restrict activities related to IVF. Some states with radical laws prohibiting abortion include carve-outs for IVF.
“The fact that abortion may no longer be available in some restrictive states may change the way people need to practice reproductive medicine, including questions about embryo transfer, preimplantation genetic testing and the like,” Cohen told Healio.
Politically, many Americans think differently about abortion and IVF, Cohen said, and may choose not to dramatically restrict activities related to assisted reproduction.
