Much of the attention being paid to the Dobbs v. Jackson Women’s Health Organization case focuses on abortion. However, the Supreme Court’s decision may influence access to assisted reproductive technology as well.
Although the leaked Supreme Court opinion exclusively focused on access to abortion, it is grounded in the idea that the law should protect unborn children. It is possible that assisted reproductive technology (ART) such as IVF treatment may be subject to this “because of the concern for the protection of unborn human beings or potential life,” Judy Daar, JD, Ambassador Patricia L. Herbold Dean and Professor of Law at Northern Kentucky University, told Healio.
“What this means for me and others in the ART field is that it’s certainly possible to imagine that laws that restrict access or certain aspects of IVF could, in fact, move forward under the same guise of the protection of unborn human beings,” Daar said.
