Patient safety alliance submits comments on Contact Lens Rule to FTC

The Healthcare Alliance for Patient Safety requested quantity limitations and elimination of robocalls and signed acknowledgment forms in its comments submitted to the FTC on the Contact Lens Rule.

After the March 7 public workshop to examine the contact lens marketplace and proposed rule changes as part of the FTC’s 10-year review process, public comments were accepted until April 6.

The alliance encourages the FTC to enforce limitation on excessive contact lens quantities and issue a statement indicating the commission’s clear intent regarding the Contact Lens Rule, according to a press release from the group.

Contact lenses are Class II and Class III medical devices regulated by the FDA, the alliance said, and brand substitution could result in significant injury, including corneal ulcers and impaired or full loss of vision.

Robocalls for passive-verification communication should be excluded, which would provide greater documentation and may provide greater oversight in the verification process, according to the release.

The alliance believes that a method less intrusive than a signed acknowledgment form could be used to educate consumers of their rights to freely receive their prescriptions while also ensuring doctors follow the law.
