Jury awards DePuy Synthes $16 million verdict in patent dispute
A jury in the U.S. District Court of Delaware has reached a verdict in favor of DePuy Synthes, and awarded the company $16 million in a patent infringement lawsuit for three of Globus Medical’s spinal implants.
“Although a formal judgment has not yet been entered in the case and there are a number of motions and hearings to be resolved, the jury found that prior versions of three products previously sold by Globus Medical did infringe on Synthes’ patents and awarded monetary damages in the amount of $16 million,” according to a Globus Medical press release. “Globus Medical had challenged the validity of the three Synthes patents at issue, and the jury upheld the patents’ validity. There was no finding of willful infringement in this lawsuit.”
According to a company press release, Globus Medical will seek to overturn the verdict in post-trial motions with the District Court and, if necessary, through the appeals process. The three products involved in the lawsuit are no longer part of the company’s product portfolio. The company also said they do not expect the verdict to impact the company’s future business, revenue or ability to sell products. Globus Medical is also not required to pay royalties to DePuy Synthes for current or future sales, according to the release.
