Class action proposal announced for data breach case against NBEO

The Maryland U.S. District Court announced a proposed settlement in litigation against the National Board of Examiners in Optometry related to an alleged data breach that occurred around June 2016.
The NBEO agreed to establish a fund of $3.25 million to compensate the victims of the data breach.
According to the settlement website, the funds will be used to reimburse out-of-pocket losses “fairly traceable” to the alleged breach up to $7,500 per person, to reimburse time spent remedying related issues up to $1,000 per person, for 3 years of free three-bureau credit monitoring and for access to identity restoration resolution services. NBEO has also agreed to upgrade its data security practices.
The district court must still decide whether to approve the settlement, according to the website.
Claims must be filed by July 8 for out-of-pocket losses and credit monitoring services, according to the settlement.
