CIBA Vision, Johnson & Johnson reach settlement over contact lenses

ATLANTA — CIBA Vision has reached a global settlement agreement with Johnson & Johnson Vision Care regarding CIBA’s patent-protected silicone hydrogel contact lens technology, according to a press release from CIBA.

Under the agreement, Johnson & Johnson will continue to manufacture, market and sell its full line of silicone hydrogel contact lenses, including Acuvue Oasys, Acuvue Advance and 1 Day Acuvue TruEye, under a license from CIBA. The lenses can be sold worldwide, including in markets previously under restriction, the release said.

The settlement concludes ongoing litigation in the U.S. and in European countries, the release said. In 2005, CIBA Vision filed suit against Vistakon, a division of Johnson & Johnson, for allegedly infringing upon CIBA’s “Nicolson” patents, which cover CIBA’s Night & Day and O2Optix breathable contact lens technology, Primary Care Optometry News previously reported.

The terms and financial details of the settlement are confidential, Richard E. Weisbarth, OD, FAAO, CIBA Vision vice president of professional affairs, said in the release.
