CIBA Vision files patent infringement lawsuit against Bausch & Lomb in Ireland

ATLANTA — CIBA Vision announced that Novartis AG has filed a patent infringement lawsuit on its behalf against Bausch & Lomb in Ireland. The suit claims that Bausch & Lomb’s PureVision contact lenses infringe an Irish patent that protects the unique technology used to develop CIBA Vision’s Focus Night & Day contact lenses, which allow 30 nights of continuous wear. Novartis is seeking to have the court prohibit Bausch & Lomb from manufacturing and selling its infringing product in Ireland.

Bausch & Lomb has released the following statement in response: “This is just another part of the long worldwide battle between Bausch & Lomb and CIBA Vision over patent rights covering silicone hydrogel extended-wear contact lens technology. In the Ireland litigation — as in other cases — Bausch & Lomb will vigorously defend its belief that the company’s PureVision lens technology is unique and does not infringe the patent in question.”
