Bausch & Lomb has filed a lawsuit against CIBA Vision for patent infringement relating to CIBA’s Focus Night & Day contact lenses, the Rochester, N.Y.-based company announced.
Previously, Bausch & Lomb filed suit in November 2001 against CIBA, based in Duluth, Ga., for patent infringement regarding the Night & Day lenses. The new lawsuit was filed the day the U.S. Patent and Trademark Office issued Bausch & Lomb a new patent relating to “chemical compositions useful in contact lenses,” the company announced.
According to a news release, Bausch & Lomb’s new patent is a continuation of the patent at issue in the company’s initial lawsuit against CIBA. Bausch & Lomb is seeking a jury trial in this lawsuit and has requested injunctive relief and monetary damages.
According to CIBA Vision spokesperson Kristie Madara, “We have just been served with this lawsuit and our attorneys have not had an opportunity to review their claims. This suit is just a continuation of a lawsuit they filed against us in November 2001. It is for additional claims they were granted yesterday on the Lai patent. We are confident in the strength of our patent protection for Focus Night & Day and will ultimately prevail when this case goes to trial.”
