Appeals court reverses injunction against BlephEx

The Court of Appeals for the Federal Circuit has reversed a lower court’s order regarding BlephEx’s ongoing patent litigation with Myco Industries.

The Federal District Court for the Eastern District of Michigan previously issued an injunction against BlephEx, the creator of the BlephEx device and eyelid cleaning procedure, from making allegations of patent infringement against Myco, according to a press release.

The appeals court, however, ruled that the district court had “abused its discretion” in the ruling, according to the court document, and that BlephEx may make patent infringement allegations.

BlephEx plans to continue its litigation defending its intellectual property, the release said.
