A second mistrial has been declared in an insider trading case against James V. Mazzo, global president ophthalmic devices at Carl Zeiss Meditec, after a jury deadlocked, the Orange County Register reported.

Mazzo, CEO of Advanced Medical Optics from 2002 to 2009, was indicted in 2014 on insider trading charges for his role in providing former professional baseball player Douglas V. DeCinces with confidential information in advance of Abbott’s 2009 acquisition of Advanced Medical Optics.

DeCinces was found guilty of 14 counts of insider trading last year, but the jury was unable to reach a verdict on Mazzo’s 27 charges, which included tender offer fraud, insider trading and securities fraud charges.

After a second trial, in which Mazzo faced four charges of perjury and 16 counts of insider trading, the jury hung with 10 voting to acquit and two in favor of conviction, according to the Orange County Business Journal.

“We respect the juries’ role and the process,” Assistant U.S. Attorney Stephen Cazares said in an email to Healio.com/OSN.
