IntraLase settles lawsuits with Escalon Medical
IRVINE, Calif. — IntraLase has settled all outstanding disputes and litigation with Escalon Medical, IntraLase announced in a press release.
Under the terms of the settlement, IntraLase will pay Escalon a lump sum of $9.6 million in exchange for the dismissal of all pending litigation between the companies. IntraLase will also permanently acquire all patents and intellectual properties licensed to it by Escalon in 1997, according to the release.
At that time, Escalon licensed 14 ultrafast laser patents to IntraLase in exchange for 25% equity in the company and ongoing royalty payments, the details of which led the two companies to battle in two U.S. district courts.
The lump sum payment satisfies any outstanding and future royalty payments owed to Escalon by IntraLase, the release said.
Both IntraLase and Escalon expect the settlement to affect 2006 earnings, according to press releases from the companies.
