Class action lawsuit filed against B&L over ReNu

Attorneys in Miami and New York are seeking class-action status for a lawsuit that blames ReNu with MoistureLoc for the plaintiff's fungal keratitis outbreaks, according to the AP.

Bausch & Lomb, manufacturer of the product, asked retailers last week to pull all remaining product from shelves and had announced it had stopped shipping the product while the Food and Drug Administration and the Centers for Disease Control and Prevention determined the cause.

According to AP, the lawsuit filed in Miami claims B&L either failed to remove the fungus from ReNu or fostered its growth in the manufacturing process.

Plaintiffs in cases such as these “typically seek to recover damages for medical screening and monitoring, lost wages, and pain and suffering,” according to a law firm that has also filed a class-action lawsuit against the company.

The lawsuit in Miami names six plaintiffs, each seeking $75,000 in damages, AP said.
