CIBA Vision files suit against Bausch & Lomb for patent infringement

ATLANTA — CIBA Vision is filing a patent infringement suit against Bausch & Lomb in Ireland to prevent the manufacture and sale of Bausch & Lomb’s PureVision contact lenses. CIBA Vision recently won a similar lawsuit in the United States, effectively preventing Bausch & Lomb from marketing the lenses until April 2005.

The current suit would prevent Bausch & Lomb from manufacturing or marketing the PureVision lens in Ireland as well. Bausch & Lomb is currently using its Irish manufacturing facilities to make the PureVision lens available to its European physicians.

CIBA Vision claims the patents in question are owned by CIBA and the Commonwealth Scientific and Industrial Research Organization of Australia, and are used in CIBA’s Focus Night & Day lenses.
