CIBA, J&J in patent dispute

ATLANTA — CIBA Vision has filed suit against Vistakon for allegedly infringing upon CIBA’s patented silicone hydrogel contact lens technology. CIBA seeks to halt a planned launch of a Johnson & Johnson silicone hydrogel extended wear contact lens, according to a CIBA press release. J&J notes this suit is in response to one filed by J&J in February.

The CIBA patents, deemed the “Nicolson” patents, cover CIBA’s Night & Day and O2Optix breathable contact lens technology, the company asserted. According to a J&J spokesperson, Johnson & Johnson Vision Care filed a lawsuit on February 8, 2005 against CIBA for a judgment that its Acuvue Oasys, J&J's newest silicone hydrogel lenses, do not infringe any valid CIBA patent.

“These patents were the subject of protracted global litigation with Bausch & Lomb that resulted in a 2004 license granted to B&L in exchange for a royalty payable to CIBA through 2014 in the U.S. and 2016 in other countries,” CIBA's release noted.

Vistakon is a division of Johnson & Johnson. CIBA has requested the District Court in Florida prevent J&J/Vistakon from manufacturing, marketing and distributing the lenses.
