B&L withdraws patent lawsuit over supplement
ROCHESTER, N.Y. — Bausch & Lomb has dismissed a patent infringement lawsuit that the company filed last week against Inverness Medical Innovations and its wholly owned subsidiary IVC Industries.
The lawsuit, filed in the U.S. District Court in Rochester, alleged that Inverness and its subsidiary manufacture and distribute a vitamin supplement that infringes B&L’s rights to the formula of its Ocuvite PreserVision supplement.
According to a press release from B&L, the lawsuit is being dismissed without prejudice after written communications from Inverness made clear that Inverness does not manufacture or distribute the private-label eye vitamins in question.
