ROCHESTER, N.Y. — Bausch & Lomb has filed suit claiming that CIBA Vision is infringing on its patent relating to a method of making contact lenses, the company announced in a press release.

In a lawsuit filed in the U.S. District Court in Rochester, B&L alleges that CIBA infringed on its patented method of cast-molding contact lenses, according to a press release issued by B&L. In this method, oxygen is removed from the plastic mold pieces before casting the lenses, the press release said.

Bausch & Lomb asked the court for injunctive relief, which would requireCIBA Vision to discontinue manufacturing its Night & Day product. In addition, the suit seeks monetary damages for infringing the patented technology. Bausch & Lomb is asking for a jury trial in this matter, according to the press release.

This is the third patent infringement lawsuit that Bausch & Lomb has brought against CIBA concerning its Focus Night & Day contact lenses.
