B&L sues CIBA for patent infringement

Bausch & Lomb has filed a lawsuit against CIBA Vision for patent infringement relating to CIBA’s Focus Night & Day contact lenses, the Rochester, N.Y.-based company announced.

Previously, Bausch & Lomb filed suit in Nov. 2001 against CIBA for patent infringement regarding the Night & Day lenses. The new lawsuit was filed the day the U.S. Patent and Trademark Office issued Bausch & Lomb a new patent relating to “chemical compositions useful in contact lenses,” the company announced.

According to a news release, Bausch & Lomb’s new patent is a continuation of the patent at issue in the company’s initial lawsuit against CIBA. Bausch & Lomb is seeking a jury trial in this lawsuit and has requested injunctive relief and monetary damages.
