Alcon files patent infringement lawsuit against Synergetics USA

Alcon has filed a counterclaim lawsuit against Synergetics USA for patent infringement, according to a statement provided by Alcon to Ocular Surgery News.
Alcon claims that Synergetics has knowingly and willfully infringed U.S. Patent No. 5,603,710, titled "Laser Delivery System with Soft Tip." The suit was filed in the United States District Court for the Northern District of Texas, the statement said.
In addition to seeking monetary reimbursements for patent infringement and an injunction to prevent Synergetics USA from continuing its infringement of the patent, Alcon has also requested that the court award its attorneys' fees and costs.
This follows the April announcement of an antitrust lawsuit filed by Synergetics alleging that Alcon has wielded its monopoly power in the vitrectomy machines market to sway purchasing decisions in favor of its surgical illumination sources and accessories.
Synergetics has not yet responded to the complaint, according to the statement
